MicroPerfumes E-Gift Card Terms & Conditions

Welcome to the MicroPerfumes E-Gift Card Terms & Conditions. These terms apply to all digital gift cards purchased, received, or redeemed in our store. By purchasing, accepting, or using a MicroPerfumes E-Gift Card, you agree to the following policies.

1. Purchasing and Redeeming

  • Purchasing: E-Gift Cards can be purchased exclusively on our website. Upon purchase, the E-Gift Card will be delivered to the email address provided at checkout. Because this is a digital-only item, no physical card will be shipped.

  • Redeeming: E-Gift Cards can only be redeemed toward the purchase of eligible products on our website. To redeem your E-Gift Card, simply enter your unique E-Gift Card code in the gift card/discount field during checkout. If your purchase amount exceeds your E-Gift Card balance, the remaining total must be paid using another accepted payment method. E-Gift Cards cannot be used to purchase other E-Gift Cards.

2. Balance Inquiries

You can check your E-Gift Card balance at any time by clicking the "View Gift Card Balance" link provided in your original E-Gift Card delivery email. If you have misplaced the email or need further assistance, please contact our Customer Support team with the email address used to purchase or receive the card.

3. Expiration Policy

Good news: your MicroPerfumes E-Gift Card does not have an expiration date! There is no time limit to use your card, so you can take your time finding the perfect scent.

4. Refunds, Returns, and Cancellations

  • Sales are Final: All E-Gift Card sales are final once delivered. E-Gift Cards cannot be returned or refunded after purchase.

  • Pre-Delivery Cancellations: If you have scheduled an E-Gift Card for a future delivery date using our "Send on" feature and wish to cancel the order, you must contact Customer Support prior to the selected delivery date.

  • Merchandise Returns: Products purchased using an E-Gift Card are subject to our standard store Return Policy. If you receive a refund for an order that was paid for with an E-Gift Card, the refund amount will be credited back to your E-Gift Card balance for future use.

5. Non-Transferability and Cash Redemption

E-Gift Cards cannot be reloaded, resold, or transferred for value. Furthermore, E-Gift Cards cannot be exchanged or redeemed for cash, except where strictly required by law (for example, in certain states where small remaining balances can be legally refunded for cash).

6. Delivery Accuracy and Risk of Loss

  • Delivery Issues: We are not responsible for E-Gift Cards that are undeliverable due to an inaccurate email address being entered at checkout. Please double-check the recipient's email address before finalizing your purchase. Should an email be returned to us due to inaccurate delivery information, we will attempt to contact the purchaser for a valid email address.

  • Risk of Loss: Please treat your E-Gift Card code like cash. The risk of loss and title for E-Gift Cards pass to the purchaser upon our electronic transmission of the card to the purchaser or the designated recipient. Lost or stolen E-Gift Cards cannot be replaced, and we are not responsible if an E-Gift Card is lost, stolen, destroyed, or used without your permission.

  • Sole Liability: If an E-Gift Card code is non-functional, your sole remedy against us, and our sole liability, shall be the full replacement of such E-Gift Card.

7. Personalized Messaging

When purchasing an E-Gift Card, you may choose to include a personalized message within the designated character limits. There is no additional charge for this feature. While we do not actively monitor every message, we reserve the right to remove, reject, or replace any language that we deem inappropriate, offensive, or otherwise objectionable.

8. Applicable Fees

We do not charge any activation, service, maintenance, or dormancy fees on our E-Gift Cards. The full value of your purchase is yours to spend.

9. Fraud and Unauthorized Use

We reserve the right to refuse, cancel, or hold E-Gift Cards and associated orders for review if we suspect that an E-Gift Card was obtained, used, or applied fraudulently, unlawfully, or otherwise in violation of these Terms & Conditions.

11. Disclaimer of Warranties

The materials on the website are provided "as is" without warranties of any kind, either express or implied, including without limitation, warranties of title, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. We expressly disclaim any duty to update or revise the materials on the websites, although such materials may be modified at any time without notice. Your use of the website is at your sole risk and you assume full responsibility for any costs associated with your use of the website. We shall not be liable for any damages of any kind related to your use of the website.

12. Indemnification

You agree to defend, indemnify, and hold MicroPerfumes harmless from and against any and all claims, damages, costs, and expenses, including attorneys' fees, arising from or related to your use of the website and/or your breach of any representation, warranty, or other provision of this Agreement.

13. Governing Law

In consideration for purchasing, receiving, or using this E-Gift Card, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the State of California, without regard to principles of conflict of laws, will govern these Terms & Conditions and apply to any disputes or claims against Perfume Ventures, Inc.

14. Dispute Resolution by Binding Individual Arbitration

ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT AND EQUITABLE CLAIMS) BETWEEN YOU AND US OR ANY OF OUR AFFILIATED ENTITIES OR OURS OR THEIR AGENTS, EMPLOYEES, PRINCIPALS, SUCCESSORS, OR ASSIGNS ARISING FROM OR RELATING TO THESE TERMS, ITS INTERPRETATION, OR THE BREACH, TERMINATION OR VALIDITY HEREOF, OR THE RELATIONSHIPS WHICH RESULT FROM THESE TERMS, SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY JAMS.

The arbitration will take place before a single retired judge in Los Angeles County, California, under the applicable JAMS arbitration rules. The arbitrator shall be empowered to grant whatever relief would be available in a court under law or in equity. The arbitration is subject to the Federal Arbitration Act, 9 U.S.C. sec. 1-16 (FAA), as amended. Any award of the arbitrator shall be final and binding on each of the parties, and may be entered as a judgment in any court of competent jurisdiction. The arbitration proceeding will be limited solely to the dispute or controversy between you and us.

YOU ACKNOWLEDGE THAT YOU ARE GIVING UP YOUR RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY WITH RESPECT TO ANY SUCH CLAIM. Nothing in this Section shall be deemed to prohibit us from seeking an injunction or other equitable relief in any court of competent jurisdiction to protect or preserve our rights in and to intellectual property or confidential information.

15. Class Action Waiver

IN ANY DISPUTE, NEITHER YOU NOR ANY OTHER PERSON SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER AFFILIATES OR PERSONS, OR ARBITRATE ANY CLAIM AS A REPRESENTATIVE OR CLASS ACTION OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. YOU ACKNOWLEDGE THAT YOU ARE GIVING UP YOUR RIGHTS TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO ANY SUCH CLAIM(S).

16. Updates to These Terms

We reserve the right to update or modify these E-Gift Card Terms & Conditions at any time without prior notice. Any changes will be posted directly to this page and will be effective immediately upon publishing.
